Please read these Terms & Conditions ("Terms") carefully before using rareshot.golf (the "Site") or purchasing from RareShot Golf ("RareShot," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.

1. Who operates this site. rareshot.golf is operated by RareShot Golf, Inc., a Delaware corporation registered to do business in New York, headquartered at 601 Euclid Ave, North Tonawanda, NY 14120.

2. Eligibility. You must be 18 or older, or the age of majority in your jurisdiction, to place an order.

3. Accounts. You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Contact help@rareshot.us if you suspect unauthorized use.

4. Products. RareShot sells collectible, tour-grade golf balls, including randomized blind-pack products (The Sleeve, The Box) with defined rarity tiers (Base, Uncommon, Rare, Ultra Rare, Secret Rare). Pack contents and odds are detailed on each product page. RareShot products are sold for personal use and collection purposes only. Rarity tier, print run size, and serial numbering are not, and should not be construed as, a representation of investment value, future resale value, or appreciation. RareShot makes no guarantee, express or implied, regarding the resale market, value, or liquidity of any product, and disclaims any characterization of its products as a financial or investment instrument.

5. Pricing. All prices are listed in U.S. dollars and are subject to change without notice. We may correct pricing errors at any time, including after an order is placed, and will issue a full refund for any order cancelled due to a pricing error.

6. Payment. Payment is processed through third-party payment processors. We do not store your full payment card information.

7. Order acceptance & cancellation. Your order is an offer to purchase, which we may accept or decline for any reason, including suspected fraud, pricing errors, or inventory unavailability. Cancelled orders are fully refunded. Contact help@rareshot.us as soon as possible if you need to cancel — we may be unable to accommodate requests once an order has entered fulfillment. RareShot reserves the right to limit or cancel quantities purchased per person, household, or order, and to refuse or cancel orders it suspects are placed by automated means (bots), for unauthorized resale, or in violation of these Terms, without liability to RareShot.

8. Shipping. Shipping is governed by our Shipping & Returns page. Risk of loss passes to you upon our delivery of the product to the shipping carrier, except as otherwise addressed there.

10. Product warranties. Products are sold "as is," without warranties of any kind, express or implied, to the fullest extent permitted by law.

11. Limitation of liability. To the fullest extent permitted by law, RareShot and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of our products, even if advised of the possibility of such damages. RareShot's total liability for any claim arising from your use of the Site or a product purchase will not exceed the amount you paid for the applicable product.

12. Dispute resolution & governing law. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Agreement to arbitrate. You and RareShot agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchase will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court. You and RareShot each waive any right to a jury trial and to participate in a class action, class arbitration, or representative action. The arbitration will be administered under the rules of a recognized arbitration provider, with the seat of arbitration in Delaware. If any part of this arbitration agreement is found unenforceable, the remainder will still apply, and the class action waiver will survive any finding that the rest of this clause is unenforceable.

13. Indemnification. You agree to indemnify, defend, and hold harmless RareShot and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site or our products, or your violation of any law or third-party right.

14. Force majeure. RareShot is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including manufacturing delays, supplier or shipping carrier disruptions, natural disasters, labor disputes, or governmental action.

15. Intellectual property. All content on the Site — including the RareShot name, logo, product designs, packaging artwork, photography, and video — is owned by or licensed to RareShot and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our written permission.

16. Prohibited use. You agree not to use the Site for any unlawful purpose, attempt unauthorized access to the Site or its systems, interfere with the Site's operation, scrape or harvest data without permission, or impersonate RareShot or any other person.

17. User-generated content. If you submit content to us — reviews, social media tags, photos, comments — you grant RareShot a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, and display that content in connection with our business and marketing.

18. Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire agreement. These Terms, together with our Privacy Policy and Shipping & Returns page, constitute the entire agreement between you and RareShot regarding the Site and your purchases, and supersede any prior agreements.

20. Changes to these Terms. We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Privacy Policy

This Privacy Policy explains how RareShot Golf ("RareShot," "we," "us," or "our") collects, uses, shares, and protects information when you visit rareshot.golf or purchase our products.

Information we collect: name, email address, shipping and billing address, phone number, IP and device information, purchase history, cookies and analytics information, marketing preferences, and, where applicable, giveaway or promotion entry information.

How we use it: to process and fulfill orders, communicate with you about your orders and inquiries, send marketing communications you've opted into, administer promotions, improve the Site and our products, detect and prevent fraud, and comply with legal obligations.

Who we share it with: Shopify (our ecommerce platform), Shopify Payments/Stripe/PayPal (payment processing), Klaviyo (email and SMS marketing), Google Analytics, Meta, and TikTok (analytics and advertising), our shipping and fulfillment providers, and GoAffPro (affiliate program management). We do not sell your personal information to third parties for their own marketing purposes without your consent.

Cookies & tracking. We use cookies and similar technologies to operate the Site, remember your preferences, and measure advertising performance. You can manage cookies through your browser settings; blocking essential cookies may affect Site functionality, including checkout.

Data retention. We retain personal information for as long as necessary to fulfill the purposes described in this Policy and to meet our legal, tax, and accounting obligations.

Your rights. You may contact us at help@rareshot.us to access, correct, or delete your personal information, or to opt out of marketing communications. We will respond to verifiable requests consistent with applicable law.

Children's privacy. The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

Security. We use commercially reasonable measures, including SSL encryption at checkout and restricted access to customer data, to protect your information. No method of transmission or storage is completely secure. In the event of a data breach affecting your personal information, we will notify you as required by applicable law.

SMS & email marketing. By opting into SMS or email marketing, you consent to receive automated marketing messages from RareShot at the number or address provided. Consent is not a condition of purchase. Message and data rates may apply. You can opt out at any time by replying STOP to any text message or using the unsubscribe link in any email.

Changes. We may update this Privacy Policy from time to time. The "Last Updated" date reflects the most recent revision.

Shipping & Returns

Shipping

• Processing time: Orders ship within 3–5 business days of purchase. Orders placed during limited drops may take longer — expected timing will be noted on the product page.
• Delivery time: 5–7 business days after shipment.
• Carrier: USPS or UPS, depending on order.
• Cost: Calculated at checkout based on order size and destination.
• Where we ship: United States only.
• Lost packages: If tracking shows a package lost in transit (not delivered), email help@rareshot.us within 30 days of the expected delivery date and we'll resolve it.
• Damaged packages: Email help@rareshot.us within 14 days of delivery with photos of the item and packaging, and we'll send a replacement or refund at no cost to you.
• Incorrect address: Please double-check your shipping address at checkout. We are not able to redirect packages once shipped and are not responsible for orders sent to an address entered incorrectly at checkout.

Pre-Order Terms (Series 1 "First Strike")

• Payment: Your card is charged in full at the time your pre-order is placed, not when it ships.
• Estimated ship window: Fall 2026. This is an estimate and may shift as we finalize production and fulfillment.
• Unit cap: Series 1 is limited to 60,000 units. Once the cap is reached, pre-orders will close.
• If the ship window changes: we will email you with an update. If you'd rather not wait, email help@rareshot.us to request a full refund.
• If Series 1 sells out or is discontinued before your order ships: we will notify you and issue a full refund.

Returns & Refunds

• Standard returns: Unopened, unused items may be returned within 14 days of delivery. Email help@rareshot.us with your order number to start a return.
• Opened mystery packs (The Sleeve, The Box): Not returnable once opened, as these are sealed collectible products. Damaged or defective product is the exception.
• Damaged or defective products: Full refund or replacement at no cost to you, including for opened packs. Email help@rareshot.us with photos.
• Return shipping: Paid by the customer, except for damaged or defective items, which RareShot covers.
• Refund timing: Refunds are issued to your original payment method within 3–5 business days of our receiving and inspecting the returned item.
• Fraud & chargeback abuse: RareShot reserves the right to refuse service, cancel orders, and pursue collection for any customer who initiates a fraudulent chargeback or payment dispute for an order that was delivered as described. Filing a chargeback does not waive our right to resolve the dispute directly with you first.

Pack Contents & Rarity

The Sleeve and The Box contain a randomized assortment of tour-grade, USGA-approved golf balls. Designs can repeat within a pack, and no rarity tier is guaranteed in any single pack — every pull is fully random.

Total production run: 30,000 balls across all designs. Approximate odds by tier: Base ~83%, Uncommon ~12%, Rare ~4%, Ultra Rare <1%, Secret Rare <1%. These figures are statistical estimates based on production planning; individual results will vary. Rarity tier and serial number reflect print scarcity only and do not represent or guarantee any resale value, collectible market value, or investment return. RareShot products are intended for personal use and enjoyment.
